ALABAMA (WHNT) – Before igniting any garbage, grass, or other materials, it’s essential to pause and review the regulations.
The Alabama Forestry Commission (AFC) has issued a reminder to residents that a permit is mandatory for burning 1/4 acre or more of the following:
- Woodland
- Grassland
- Fields
- New ground
This requirement is also applicable if the burn site is located within 25 feet of any natural fuel, such as wood or grass. To obtain a free permit, individuals should contact the AFC dispatch center at (800) 392-5679. During the call, the dispatcher will inquire about various details related to the burn, including:
- Location: Provide geographical Lat/Lon coordinates, which can be determined through the AFC website.
- Size of the burn
- Material being burned
- Purpose of the burn
In addition to securing a permit, applicants must ensure they have the necessary tools, equipment, and manpower to monitor and control the fire throughout its duration. Even with a permit, the individual responsible for the burn remains liable for any damage caused by smoke or if the fire spreads uncontrollably. The AFC holds the authority to revoke a burn permit under the following conditions:
- The burner does not comply with the permit’s terms.
- Changing weather conditions lead to dangerous or unpredictable fire behavior.
- Smoke from the fire poses a hazard to others or worsens air quality.
Violating burn permit regulations may result in fines of up to $1,000 and possible jail time of up to six months. It’s also important to note that state law prohibits the burning of household garbage and trash.

Local Regulations and Seasonal Burn Bans
While there is a state burn permit law in place, individual cities and towns may enforce their own burning regulations. Those intending to burn should verify requirements with their local fire department. Additionally, the AFC advises notifying local fire officials prior to burning.
From May to October, a non-agricultural burn ban is in effect for certain counties across Alabama, including:
- Baldwin
- DeKalb
- Etowah
- Jefferson (where Health Department regulations prohibit all planned burns during these months)
- Lawrence
- Madison
- Mobile
- Montgomery
- Morgan
- Russell
- Shelby
- Talladega
